Legal Question in Consumer Law in Virginia

I bought a used car AS IS from this guy from Craigslist. In the ad it says that the car is 100% drivable. I did not know that besides inspection the car needed to pass the emissions test. I learned that when I went to the DMV to transfer the title and register the car, they told me that I have one month to come back with the emissions test passed. The guy said I could take the car and it would pass the emissions test (I have a witness). I already paid him in cash the amount of 3.450,00 dollars. When we signed a bill of sale he asked me what amount I wanted to put there, so he "tricked" me into putting a smaller amount of 2k (less taxes). The problem is the car will not pass the emission test. The mechanic said that it cannot be fixed unless the whole engine is replaced which would be around 2000 dollars. What can I do legally in this matter? Can I take him to court? Is that going to cost money? If I explain at the court, will I be able to refund the whole amount (3,450)?

Sue the SOB in small claims court for fraud and misrepresentation for $3450 + the costs involved in filing your case (which should not exceed $60-$70).
