Legal Question in Consumer Law in Virginia

Bought used car with undisclosed collision damage

I purchased a 1995 Nissan Maxima from a private party in Philidelphia, PA. on April 3, 2004. Took it to a mechanic on April 6th. Found out that it had been in a mjor collision even though the title was clear. Does the seller need to buy the vehicle back becuase of not disclosing the that the car had been in a collision? I live in Virgina.

Don't know what the law is in PA but I suspect you are out of luck, next time use Carfax.

Private sales of automobiles are normally done on an "as is" basis and without the battery of contractual and statutory warranties which usually accompany the purchase of a new vehicle or, in some cases, even a used one purchased from a commercial seller.

I'd warrant(with pun intended) that you're most likely out of luck on this one.
