Campground membership laws.

Can a campground I am a member of cancell my membership, demand full payment for the year, and keep, or deny me acess to my camper if I don't pay? This is in Buchanan Virginia.

Thanks

I couldn't say for sure without reviewing your contract which presumably spells out the terms of your membership, but if you're in violation of any of its provisions, I suspect that the campground company can probably get away with what you've described.

Re: Campground membership laws.

They CANNOT keep your camper... unless you signed something in the contract giving them the right to hang on to your camper, they would have no right to do that. They only way a creditor can grab someone's property is to (1) file a lawsuit and WIN it, and then follow carefully designed procedures in court, or (2) if there is some special situation like repossession of a car where the loan is ON the car, or you give a car to a mechanic and the mechanic can hold on to the car until the repairs are paid.

Otherwise, if they will not give you your camper back, you might consider having a talk with the Sheriff's office. Ask to see the magistrate. You can also file a lawsuit for "detinue" to get your camper back. It is possible that you could have a lawsuit for "conversion" of your property and perhaps ask for punitive damages, or similar concepts.
