Legal Question in Consumer Law in Virginia

New Car Purchase

I purchased a new 2008 Toyota RAV4 on Wednesday evening. The car title and loan is in my wife's name and I am the co-signer because the finance officer said that I could get a better rate by using my wife's credit score vice mine. I signed all of the paperwork and they left my wife's signature blank because she was suppose to go in tomorrow to sign the contracts. However, my wife changed her mind in getting a new vehicle due to her losing the income we would have used to pay for the car. She now refuses to sign any paperwork. My question is, is this car purchase still valid with only my signture as the co-signer? I live in Virginia and I read where in Va. it is possible that a legally married spouse cannot buy or sell a vehicle unless they have written consent or the spouses' signature on the contract.

Thank you for your assistance. Marvin

Re: New Car Purchase

No, I know of no such requirement in Virginia law, and it would seem to me that if the car dealer wants to sell you the vehicle with just the one signature, that he could do it.
