Legal Question in Consumer Law in Virginia

new car purchase

I my son recently signed a contract for a new car from a local dealer. The dealer let him sign for the car and drive away. He is under the 0-0-0 plan no down payment, no payments for 6 months.

The same dealer called back ( after about 2 months ) and requested me (father) to sign for my son on a new contract.

What are my leagal rights ?

Re: new car purchase

Unless the car was sold conditionally to your son, you have no duty whatsoever to co-sign a note for the car. The car was probably sold as a final contract, and so the dealer should be stuck with the terms of the contract agreed to. The dealer cannot then come back and try to change the deal.

Review the sales agreement with the dealer and your son. If it this contract is conditioned upon financing being approved, then the dealer may have the right to change the deal now. But most likely it will read as a final contract without conditions. Then you have no duty to co-sign. If the dealer then threatens repossession if you do not co-sign, etc. you should consult an attorney.
