Legal Question in Consumer Law in Virginia
New car purshase and installment loan
i signed a new car contract( buyers work order )with a vin no. Also a retail installment contract with the same vin no. The dealer refused to deliver the truck unless i added 5k to the price because theysaid they didnot include the price of the utility bed that was on the truck. This was on 10 27 07. On 10 31 07 the dealer faxed and called the credit co. And withdrew the request on the loan that had a approval.
Question 1 do i have l contract for purshase of a vehicle that the dealer cannot change the price without my consent?
2) can the dealer withdraw a approved credit agreement for the vehicle without my consent because they refuse to deliver the vehicle without a price increase?

Re: New car purshase and installment loan
If there was a genuine mistake in the contract regarding the utility bed for the truck, then there was likely no required meeting of the minds and the contract is probably unenforceable.
However, if the contract clearly included the utility bed as part of the original agreed upon purchase price and then the dealer changed his mind, you should be able to enforce the contract against the dealer for the price that was originally agreed to.
And, yes, the dealer can withdraw the financing arrangements without your consent since the credit agreement would have been arranged for by him rather than you.
