Cashing a refund check that is for the wrong amount.
I received a refund check from a national retailer. I placed an online order and part of the order was canceled, but they issued me a check for the entire order amount. The Company owes me a refund but not for the amount of the check. If I cash the check what is the legal ramifications. Is this a civil or criminal matter.

Not necessarily either. I see no problem with your cashing a refund check from the retailer which is properly made out to you as payee and depositing the funds in your account, and then reserving the amount of supposed overage in the event that the company requests a partial refund of their refund----which you should return. (I assume that this amount is relatively small and does not involve many thousands or even hundreds of dollars of erroneous refund.)
