Legal Question in Consumer Law in Virginia

I bought a phone this company and I sent it in for repair. I recieved it but now I can't call anyone. They said send the phone again but I just want a new unit. It took three months to get my phone. Is there a law about getting a new unit. That company is in NEW YORK but i'm in virginia.

Better send the phone again and ask for a replacement unit, if necessary.
There are no special laws in the Code of Virginia of which I'm aware to address this particular situation.
