Legal Question in Consumer Law in Virginia

Contract

I signed a contract to buy a new car from a dealership , I found out today that the person who sold me the car signed the wrong line and now they want me to sign another contract. Does that make the original contract null and void therefore the warranty criteria void? Meaning will my contract then start as of the date that I sign the new contract?

Re: Contract

If the transaction involves a demand that you return the car, or if the new terms are in any way different, consult a lawyer. Probably you should go over there in some other car.

Re: Contract

If you were trying to get out of the contract, I could argue that the contract was not valid. But because they are trying to make it enforceable, they are "ratifying" the contract (approving it after the fact).

If you want to agree with them that the contract should be enforced, then there should not be any problem with that.

However, I would insist that they sign the original contract in the proper place, rather than signing a new contract. I would refuse to sign a new contract, for the reasons that you ask about.

They can "ratify" the original contract by signing it now, and it will be entirely good.

Re: Contract

This sounds like a mere remedying of what one might term a cosmetic defect of sorts, and which, legally might be viewed as merely an emendation of the original contract which continues in force will all warranties from the date on which you signed this original.
