Filing in small claims

Hi.. I recently hired a contractor to refinish my floors during the time that we were out on vacation over a week. However, the job did not get completed. I have contacted him several times over the past two weeks. How long should I give him to make good on his contract before I take him to court? I have only given him a 1000 dollar deposite for the work that was to be done and not sure how much I can sue him for as he did not complete aspects of the job as discussed and the job is unfinished.

You could sue the contractor for the difference between the $1000 deposit you paid him and the value of the work completed plus court costs.

If the value of the work he completed is equal to or greater than that deposit, you should simply hire another contractor to complete the job.
