Legal Question in Consumer Law in Virginia
Internet false advertising ?
I was looking for a video game. I searched the net. The game was listed on a internet game by mail provider's site from California as available. It was not available anywhere else (hint, hint). I emailed them that I did not want to sign up unless they had the game. I asked if they had the game. I got an email from them saying yes, they had the game. I signed up for their service. They did not have the game. I found out the game was not to be released until 6 months later. I emailed them immediately (within days) that I did not want to be a part of their service if they did not have the game. Six months later, they sent the game. I sent it back. Months later, they turned over my account to a collection agency (slightly over $100 dollars). Now, I have a mark on my otherwise perfect credit report. The better business bureau does not want to take my complaint because it might involve fraud, legal action. Its a small deal, but I would rather pay a lawyer than this company who lied about having an advertised product (I have emails). What should I do ? Please help. Thank you.

You could sue for damages(probably in small claims court)in California. If the defendant company's only commercial connections with Virginia is the Internet, this type of contact would proably not suffice to provide the basis for a viable suit against them from Virginia.
