Legal Question in Consumer Law in Virginia

Internet purchase

Can I cancel a purchase made thru the internet on my computor by a minor using my credit card information. I sent an e-mail to the company that charged my account on the same day of the purchase stating this. What else can I do?

Re: Internet purchase

A minor does not have legal capacity to

enter into a contract (except perhaps for

necessary items like food and medical emergencies).

Therefore, the contract is void.

But the problem will be convincing anyone that

it was your minor child and not you, if he or

she used your log-in and your credit card. But

in theory, the purchase is void.

Re: Internet purchase

Sure, you should be able to cancel an Internet purchase such as you've described. Nevertheless, assuming that your request is ignored (for whatever reason) and the item shipped, simply return the item whenever you receive it and demand a full refund(including the cost of postage).

If the above doesn't work, you can always formally notify your card issuer in writing that

you're placing in contest the purchase for the reasons stated.
