what is lien?

How is a lien created? I asked a garage to check my car and give an estimate on a repair. I dropped it off in the morning before work and called them later. When I called back and found out was wrong with my car, I told them I didn't want the work done. I asked them if there was a charge for the estimate, they said no. I did not sign anything or agree to have any of the work done. After work I went to get my car, they claim to have done the work that I told them not to do and they charged me $535 for a repair that I didn't want done. The garage claims to have lien on my car and I can't get it back without paying for it or being arrested. They threatened to do that if I take my car. This sounds like extortion to me. I have bought a new car so I really don't need my old car. It is my property so I do want it back. Do they have a legal lien on my car? I also don't think they did any of the work they are charging me for.

The repair shop has a form of mechanics lien on your vehicle for the value of the work they claim was done. If you were to take the vehicle without making full payment and without their permission, you could, indeed be charged with a form of theft.

If you want the vehicle back, your proper course is to pay the bill and seek recovery in small claims court.
