Legal Question in Consumer Law in Virginia
I live in Virginia and need to know if I can file a small claims action here against a business in New York concerning a item that was purchased on line, received here in Virginia, found to be defective and returned to New York with a promise of a refund. Have not received the refund and need to know I can file here or if I must do so in New York where the business is located, or what options are available to me.

Your best chances to obtain any recovery for your loss as described would be to file your claim in New York.
(Even if you were to obtain a judgment against this company in Virginia--assuming the issue of jurisdiction
were resolved in your favor--enforcement of the Virginia judgment against this New York company would
likely prove problematical at best in my opinion).
