Legal Question in Consumer Law in Virginia

lost wedding photos

My wife and I took a roll of our Wedding photos to our local Rite-Aid, and we havent been able to retrieve them. They sent them to a company named Qualex, who sent them back to Rite-Aid. For some unknown reason they sent them back to Qualex as ''unclaimed'' yet at no time were we ever notified they were ready for pick up. I spoke to someone at Qualex who told me we would likely never see our Wedding photos. My wife especially is extremely upset about this, understandably so. Do we have any sort of suit against Rite-Aid or Quakex , or both.

I see no reason why you should not be able to hold

at least Rite-Aid responsible which apparently on this occasion certainly failed to demonstrate that they have the "right stuff" regarding their procedures for photo processing.

The question remains, nontheless, as to what would be a fair value to put on these lost photos in order to determine your recoverable damages.

I myself have no idea, but assume that it would be something more than the mere cost of the film involved, and, perhaps, costs associated with the taking of the pictures.
