Legal Question in Consumer Law in Virginia

Purchased a new car with extended warrenty thru dealer. If you don't use the warrenty you get your money back in full. I have this in writing from dealer. The problem is that in the fine print it states I have 90 days from expiration to get my claim in. Well I miissed the time line of 72 months by 3 months but I didn't exceed the 100k miles which is what I had my mind fixed on. Either way the dealer has no stake in this and won't give my money back. what can I do?

The fine print would seem to win out here, i.e., you 're without

a remedy (in my opinion).
