Legal Question in Consumer Law in Virginia

I purchased a new Ford Vehicle in March 2016. The vehicle has been out of service for 32 days for an issue and it was fixed. Now, another problem appears, so my vehicle is at the dealership for 34 days and counting now. Do I have a lemon law case?

VA Code Secs. 59.1-207.9 et seq..specifies the following: "if within 18 months

following the date of the motor vehicle's original delivery, 3. The motor vehicle is out

of service due to repair for cumulative total of 30 calendar days, unless repairs could not be performed because of conditions beyond the control of the manufacturer, its

agents or authorized dealers, including war, invasion, strike, fire, flood, or other

natural disasters"

Therefore, in view of the foregoing (and the facts you've described), it would appear that, yes, you do have a prima facie

case for violation of Virginia lemon law (my opinion).
