Legal Question in Consumer Law in Virginia

Questionable billing charges

The pump to my well recently broke for the third time in just over a year. The man that dug the well fixed it the first two times. When I called him this last time he stated that the warranty has expired. I stated that it is unacceptable for a product to break that often. He told me he would send someone out the next morning. No mention of charges. Today, I recieved a bill for $240. Am I legally obligated to pay this bill, if no contract was signed and there was no mention of charges on the phone? Thank you for your time.

Re: Questionable billing charges

Yes, I'd say you're likely obligated to pay the bill, but why not call the man and ask for clarification?

Re: Questionable billing charges

You might argue that the pump, etc. did not conform to the warranty and that you believed this was a repair covered under the warranty, based on his representation.
