Need help with refund claim against Furniture store

Brief Description of the issue:

1) In august 2008, I purchased furniture for my living room and bedroom from local furniture store.

2) Delivery of this furniture was NOT done until end of october 2008.

3) After numerous phone calls, store finally delivered the living room furniture and part of bedroom furniture in Nov 2008. Store agreed to deliver remaining furniture soon.

4) Remaining bedroom furniture NEVER arrived. I had to call store multiple times and everytime I was told that furniture will be delivered soon.

5) Finally in Feb 2009, after several phone calls and store visits, store manager finally agreed to process return for bedroom furniture.

6) Bedroom furniture was returned in Mid Feb 2009 and store agreed to pay the refund within 30 days

7) As of date refund is NOT done. Store manager is NOT returning the calls and last time when I visited the store, he declined to pay the money claiming that he has paid the money on my check card

8) When asked more during my store visit, store manager declined to provide me any more info or proof of refund and instead called police to remove me from the premises.

During this visit I also found that this store is going out of business in next few days

Please advice...

If the store is going out of business in a few days, it's probably now too late to recover your money. However, you could still file a warrant in debt for up to 5K against the store in your local small claims court and see what happens after the papers are served by the local sheriff's deputy.
