Legal Question in Consumer Law in Virginia

repair gone bad

I had a local hvac company come out and give an estimate on the repair of my ac unit. The initial estimate was around 300$ The hvac mechanic made the repair and the unit was working perfectly. During the process of putting the covers back on the condenser unit the mechanic put a screw through my coil. The company has sent people out several times to try and repair the hole but they have decided that because of the age of the coil the tubing cannot be repaired. The company is now trying to tell me that the only option for air conditioning is to install an entirely new system because they are unable to find a condenser that will work with the existing air handler unit. This could cost me thousands of dollars obviously. Why would the company not be fully liable for their services rendered and the result of their employees mistake. I understand accidents happen but this accident has ruined by Central Air Conditioning in the dead of summer. What can I do?

Re: repair gone bad

Sue these liability-evading SOB's in small claims court for all that you can get(jurisdictional limit $5K.)(And,yes, the company's errant screw negligently penetrating your condenser's coil, would appear to be what the law calls the proximate cause of the damages to your AC unit for which this company should be fully responsible.)
