Legal Question in Consumer Law in Virginia
ripped off!
I transported a car to a shop to get some work done (modifying for race). A deposit of $700 was put down this same day. I was initiallly told that the job would take 2 months. It has now been 8 months and the car is still not done. Furthermore, the price has been quadrupalled! I did not authorize any additional work to be done than what was stated initially. My initial mechanic left and was replaced with someone unfamiliar to this type of work on this type of car. What is worse is that I was mailed a letter from EZ-Pass stating that I went thru a toll and did not pay. I told them to send me pictures. The pictures shown were of another car (shop owner's) going thru the toll and not paying. Can I file a writ of replevin and get my car back. The owner showed me a detailed billing of the work done, parts used. Only they billed me for the parts I PROVIDED THEM! Also they ''say'' that they installed certain parts that do not go on my type of vehicle. Billing was EXTREMELY padded to say the least. What if they try to sell my car?

You could file what's called a warrant in detinue in the general district court(assuming value not exceeding $15K for the vehicle)requesting the return of the vehicle as your personal property or in the alternative a judgment against the shop for the fair market value of the vehicle minus the value of any work performed and parts replaced by the shop.
