Verbal Contract for Flooring

I entered into a verbal agreement with a flooring contractor to install bamboo flooring in my home. The contractor advertised his crew as experienced and agreed to do a professional installation. Before the job was started I offered the recommended installation instructions but they indicated they didn't need them. After day 2 I noticed that my material has little humps in the wood everywhere that they stapled. I also noticed cracked boards that were left in place. The bottom line is that I have not given a penny for installation, the job is in need of repairs due to a bad installation, the job is not completed and I provided the materials and am out about 10k. My question is; What is my legal obligation to this contractor at this point? Can I take my installation money and go get a good contractor to finish, repair and complete the job without paying the first the guy anything?

Yes, of course, if the work is truly as shoddy as you describe, but see whether the guy you hire to fix the botched job will be willing to testify

as an expert in your defense in case the first fellow hails you into court on an alleged breach of contract suit.
