Legal Question in Credit and Debt Law in Virginia

My 24 year old son is being taken to court for an unpaid credit card ($1300). He tried, unsuccessfully, several times to explain his situation and that he had no money but they never listened. He is paid cash (when there is work) and owns nothing. What can they do? Can he go to jail? I would pay it but I don't have it either. Should he have an attorney? Should he file bankruptcy?

The creditor will proceed to garnish your sons wages. They can't put him in jail. Bankruptcy is always an option. But if he has no job and no assets he is judgement proof (they can't get anything out of him). See my site for more info
