What are the proper steps to repocess an auto that payments have not been made as expected between private individuals in the state of Virginia?

Depends upon who has legal title to the

vehicle. If you still are the owner of record(meaning title is still in your name), you can go and claim the vehicle at any time (or hire a repo man to do it). However, if you signed over the vehicle to this defaulting buyer and legal title now is vested in his or her name, you must file your suit for damages against the defaulting buyer in the appropriate Virginia court.
