We originally went with a settlement co. to try and eliminate our cc debt. After a two months in the program Bank of America sent a letter saying they do not work with settlement companies and sent our account to a collection agency. The collection agency wants either the payment in full, or a large amount up front then a monthly. There is no way I can pay the large amount up front. Is this fair . Is there any solution to get my debt paid without litigation.

No, it is probably not fair, but as we
adults all know by now, life if full of unfairness. And, no, unfortunately, there is no solution (of which I am aware) to your situation that would allow you to avoid litigation unless your creditor is willing to allow for that such as through a negotiated settlement.
