Legal Question in Credit and Debt Law in Virginia

Bank Garnishment

An attorney filed and recvd a judgemnet against me for a vet bill & also filed a garnishment for the full amt on my bank acct. I never recvd any paperwork pertaining to this matter and when I called the attorney office they had the incorrect address listed. Is there anything I could do to dispute the judgement since I didnt know about it and are there limitations on how much they can take out of my bank account if I have direct deposit?

Re: Bank Garnishment

Yes, you could file a motion to have the judgment set aside for lack of proper service upon you and notice of the lawsuit.

Wage garnishments are limited to 25% of the debtor's net salary, but there is no such limit as to the debtor's bank account.
