Bank Garnishment

I received notice from my bank that they have frozen my account for $3800 and I only had $140 in there to begin with, all of which was my husband's unemployment benefits as neither of us are employed and trying to find employment.

I am asking about improper venue for one as this was filed in Roanoke City and I live in Bedford County and did not setup or sign anything for this account in Roanoke. It was a credit account to pay on medical bills called MedKey - which initially ran up a balance without me consenting to allow those charges.

If the plaintiff received a valid judgment against you in a court in Roanoke, it could certainly be enforced against any account you may have with a bank in Bedford County or elsewhere in the Commonwealth, and, consequently, "improper venue" is unlikely to be a valid basis for your defense.

Nevertheless, if you believe that you may have one or more other(possibly)valid defenses to this claim, you should arrange to consult with a local attorney who handles consumer affairs issues in your area and who should be able to further advise you on this particular matter.
