Legal Question in Credit and Debt Law in Virginia

Bank levy

I live in Texas and opened a checking account with a bank with branches world wide. A debt collection attorney in VA froze my bank account claiming that since my bank has a branch in VA he can lawfully do this. Is this true?

He is now trying to freeze my checking acct with my local credit union stating that they have ATM in various airport location, eventhough they are Headquartered in Texas.

You should be consulting wih a Texas attorney who is experienced with credit and collection matters and who can advise you on this particular matter (in my opinion). (You could also immediately protest this levy with the Texas bank where you opened your account and find out their position on it before contacting the attorney.)

The major legal issues would seem to involve first whether there has been a valid judgment entered against you in Virgina and whether the fact of your

Texas bank having a branch there provides the requisite contacts specified in such U.S. Supreme Court cases as Shaffer and International Shoe that would permit the kind of trans-state enforcement action which you've described.
