Legal Question in Credit and Debt Law in Virginia

Bounced Checks

My wife wrote two checks for $100/each to her local vet over 1 year ago which she post-dated. Shortly thereafter, she was hospitalized and became unemployed.

The vet is now suing her for the checks and bounced check fess/court costs for over $1000. She is still not working, has no income and has no reliable transportation. (I am currently living in New York where I am employed). Money is tight right now and I dont have the funds to pay the $1000 they are asking for.

Can she go to jail for this? She missed her last appearance in court because she does not have a car and I have been forced to remain in NY to work.

Any advice would be appreciated.

Re: Bounced Checks

If it's not a criminal but rather a civil case, your wife will not be going to jail(even if she's found liable and a judgment is entered against her).

Nevertheless, she would likely be far better off to work out some sort of settlement with the vet in which she would be allowed to pay off this debt over time in monthly installments which she could afford.
