Legal Question in Credit and Debt Law in Virginia

I was given a check by my tentan for $585 to deposit by July 1st 2009. She called me and told me there was not enough fund in her bank for me to deposit the check. In order to avoid the fee of bounced check, I did not deposit the check. As of today Aug 1st, I was still unable to deposit the check. What can I do to collect the fund on the check.

Serve the tenant with the 5 DAY PAY OR QUIT notice.
