checks obtained under false pretense
Our landlord insisted he needed 3 checks made out to prove to a financial institution and insurance co. that the property was rented. 3 checks were given of $575 each. 11 months later after learning we planned to move, he deposited them. A stop payment was done 3 weeks prior. The bank stamped NSF, but issued us a letter stating it was their mistake since the stop was 3 weeks before. Landlord has filed a debt suit. Who is right?
