i closed my credit card in 2003. i owe $3000 and they are suing me for garnishment in nov. 2010. isn't statute of limitations for Va. 3 years?

No, most likely five years (but possibly three if considered an open account).

However, in any case, the statute of limitations must be raised by the defendant (you) as an affirmative defense in responding to the card isuer's lawsuit and

failure to do so operates in effect as a waiver.
