Legal Question in Credit and Debt Law in Virginia
Collect on Judgments
I took someone to court to collect money. A judgement was placed on him. Started garnishment paperwork on him. He filed for bankruptcy. Bankruptcy was dismissed. How can I now go about collecting my money?

Re: Collect on Judgments
If the bankruptcy was DISMISSED, it is as if it was never filed, and you can collect the same as before. Do not confuse DISMISSED with DISCHARGED. A discharge is an order barring the collection of debts against the debtor. If the case was discharged, you cannot collect your money.
