Legal Question in Credit and Debt Law in Virginia

collection of antecedent debt

i was awarded a judgment in a virginia civil court last year for antecednt debt of over $20,000. it was to be paid in installments of $400/month. my ex husband has made no attempt to pay this judgment. ( he filed bankrupcy and this debt was found to be non dischargeable...he had to repay the debt placed on me thru his bankrupcy) i have domesticated the judgment order and placed a lein on the money he is due from his mother's estate in alabama. he says he only has to bring the debt current ($4,800). can i collect the entire debt? the judgment was given 12 months ago but he stuck me with the debt 2 1/2 years ago. i am paying 11% interest on the debt. i am seeking the full judgment b/c he has proved he is not going to pay the installments. please help...thanks

I'm with you, i.e., once your husband became in complete default on the obligation, I know of no reason as to why you should not(legally or morally) proceed to collect the full amount owed under the judgment.
