Legal Question in Credit and Debt Law in Virginia
collection in civil case
I am from Virginia
I won a settlement against Woman A for $6,000.
She never paid and has no intention of ever paying.
I took her to court for Summons To Answer Interrogatories. She stated she has no money, no job, no car, lives with her father, no credit cards, nothing. ALL LIES.
She owns a ''timeshare'' with Wyndham Hotels and Resorts. (She told the court that it had been forclosed, another lie, I just checked)
Can I put a lien on a timeshare??? I'm not sure if she actually owns physical property or not, I think she gets timeshare points or something. But i guess she has some equity there, Wyndham insists she is still in good standig with them.
PLEASE HELP!!!!

Re: collection in civil case
If you have a judgment, you should be able to execute on her time share. If it is a deeded interest, which most are, you would need to record your judgment in the state/county where the deeded timeshare is located. Be aware, though, that the resale market for timeshares is not very strong, and you may not recover enough to make it worthwhile to execute on such an asset.
