Legal Question in Credit and Debt Law in Virginia

Contract: Binding or Not?

I went to a seminar about a web-based business and agreed to start a web-base business to make money at home, in return this co. was to provide me w/all neccessary materials for a fee. I never started a business nor used any of their services. I also did not make any pmts for the services at all. I requested to cancel the plan but after the 3 day period, since I never used their service nor gave them any money am I liable for this dept? It is being reported on my crd report as a bad dept.

Re: Contract: Binding or Not?

I am not sure from your question whether you

actually received the package or not.

If you signed a contract and NEITHER side

fulfilled the contract (they did not send you

the package and you did not pay), then they will

have a very hard time collecting in court.

They would have to prove what they have lost by

the breach of contract, and because they did not

perform either, their losses would be $0.00. So

they would probably "win" $0.00.

However, if they sent you a package and you

simply did not use it, then you would be

responsible. It is up to you whether or not you

want to use what you buy.

So it is a little unclear from your question

what the situation is.

As far as credit reports are, busineses can

pretty much report anything they want on your

credit report, true or untrue. Thank your

Congressman for laws that make it almost

impossible to hold the credit bureaus

responsible. So there is really very little you

can do until they actually sue you in court.

Then they have to prove it.
