Legal Question in Credit and Debt Law in Virginia

Contract Purchase of Furniture

I purchased furniture 2yrs ago. My contract was up in November. The furniture company ''alledgely'' sued me in court. I never was served a summons, but the sheriff ''claims'', he left it on the door. I did not dispute what I owed, however, after speaking to a supervisor I was told they would be garnishing my wages. Instead, they garnished my bank account without me knowing it. I asked why didn't they garnishment my wages, like the lady said they would, they said they had the right to do whatever. Do I have a case to take to court?..I am a single mom, and they have left me with no money. I was at the store trying to buy food, when I found out I had no money. I don't know what to do?

Re: Contract Purchase of Furniture

If the furniture company obtained a valid and enforceable judgment against you for the outstanding amounts still owed, then they were also entitled to seize(levy against) your bank account as well as garnish your wages. Unlike with

a garnishment for wages which is limited to 25% of disposable income after all mandatory deductions, a judgment creditor can usually take the entire amount in the debtor's bank account (up to the amount owed) except for certain funds that may be clearly identified as exempt such as certain social security payments.
