Legal Question in Credit and Debt Law in Virginia
credit card debt of deceased spouse
My husband passed away leaving credit card debt. They were all in his name, but I was an authorized user. Am I required to take on this debt?

Re: credit card debt of deceased spouse
No, as his spouse your legal obligations for his debt would likely only include responsibility for debts which your deceased husband may have incurred for the so-called necessaries of life, such as food, shelter, medical care, etc. If your deceased husband's debt does not include indebtedness incurred for these aforementioned necessaries, then you would not be responsible for the rest of it but you would, of course, have a moral responsiblity to pay for anything which you yourself incurred an an authorized user.
