Legal Question in Credit and Debt Law in Virginia

credit card debt on secured card

My husband got a secured credit card several years ago for $1000...he gave them $1000 and they gave him a credit card for the same amount. Once my husband used the $1000 on the card he chose not continue with them.... in other words he used ''his'' $1000 and that was it. Now he finds out that they filed a judgement on him in 2001 for the $1000. Is this legal? He used his own money. He was never informed of the court date to defend himself. Is there anything he can do to overturn the judgement?

Re: credit card debt on secured card

More information would be necessary in order to make a reliable determination as to the legality regarding the actions attributed to the creditor.

If your husband was never properly served with notice of the suit which resulted in the judgment against him, it may be possible to have it set aside or vacated.

It would appear that he would be well advised to arrange a consultation with an attorney to review the matter along with the relevant documents and facts.
