Legal Question in Credit and Debt Law in Virginia
Credit Card Debts
I have several credit cards and have been sending each of them whatever I can each month. Between being layed off while on maternity leave due to the collapse of the mortgage industry, a new job with a big pay cut and a new baby, there is only so much left over. I received a letter from Bank of America stating that if I do not send them $904 in a week then they will file suit. They are already charging totally outrageous rip off interest. My husband and I have one thing joint - the mortgage. What is Bank of America going to do? I really am doing the best I can. Can they garnish, put a lien on the house or go after hubby even though he isn't on the account? The Bank of America debt amount is around $5,000.

Re: Credit Card Debts
Yes, they may very well sue but that wouldn't automatically give them a lien on your house. After getting a judgment they could garnish your wages but they can't go after "hubby." If they serve you with a summons to attend court then you should contact a consumer law attorney ASAP.
