Legal Question in Credit and Debt Law in Virginia

Credit Card Dispute

I had a Capital One card that has long been cancelled. They attempted to charge me an ''annual fee.'' I didn't pay it obviously, but they continued to bill be and assess finance and interest charges so now it is up to 1200 bucks. They want to take me to court now. I know this is a common practice of Cap One. What do I do? i don't have proof of when this account was closed; it's very old. Is it better to let them get a judgement against me or pay it and try to appeal?

Re: Credit Card Dispute

No, it is better to contest their efforts to get a judgment against you since if you pay it you would likely have compromised, if not obviated, any basis for appeal.

Re: Credit Card Dispute

You should not let them have judgment if you don't owe it. You might consider filing your own case against them. Good luck.
