Credit collection issue
My wife belongs to Gold's Gym that
we used to have payments deducted
automatically. It stopped last
November. We didn't notice that it
stopped and we started getting
recorded phone calls saying to ''call
us about your gym membership...''
with no mention of Gold's. After a
few weeks of these calls, I finally
called and the phone number was
not a correct number. I can't
remember exactly how we
discovered the calls were related to
Gold's, I believe I called the actual
gym and they gave me the name of
ABC financial. I finally got a good
number for them and talked to
someone there and they said that
we had sent a fax asking them to
stop the payments, but we did not.
Again I can't recall all the details, but
about a month past while I was
trying to sort this out and they sent
us to a collection agency. My wife
paid $150 to the agency but now
they have no record of this and have
charged us again. I am trying to get
a clearance, this could affect it, can
we sue Gold's and ABC financial?

It was a mistake for your wife to pay anything to the collection agency under hese circumstances, but if Gold's refuses to credit your account for the $150 that apparently now remains unaccounted for, you may wish to consider suing the gym in small claims court for this amount plus recoverable costs, but beyond that I don't see your claim(s) going anywhere.
