Legal Question in Credit and Debt Law in Virginia

I have an cell phone with Altel. My account is due on the 10th each month. If I have not paid it by the 15th I will literally get 50 text messages which go on all night long. I have to keep the phone on for potential family emergencies...they live out of state. Is it legal for them to keep sending me text messages all night long? My phone keeps going off all night long. Altel says they can not change the date of my plan so the due date is the 15th when I get paid. Can they send me text messages all night long? I thought is was only legal to call something like 7A to 9P. Please let me know.

Why worry about legalities here when very likely there are none which apply to this situation? Just get another phone and service provider who will give you an account due date on the 15th of the month and who will not bombard you with text messages.
