Legal Question in Credit and Debt Law in Virginia

Debt Collection Lawsuit for family in deportation

I have a family member who has been incarcerated for about a year now for a DUI. In a couple of months, he will be transferred to the US Immigration and Customs Enforcement agency for deportation. He has an aggravated felony he will not be able to fight the deportation. A lawyer working on behalf of a financial institution is suing for about $20,000 in court next month. What is the best way to deal with this matter. Should we contact this lawyer and his creditors and tell them what is going on? Should the family member declare personal bankruptcy?

Re: Debt Collection Lawsuit for family in deportation

If this family member is going to be deported, it would appear that any efforts by his creditor to

secure a judgment against him and any subsequent efforts to collect it will likely be largely unavailing. Consequently, it probably makes little sense for him to expend the effort and expense of going through bankruptcy in order to discharge this particular debt.
