Legal Question in Credit and Debt Law in Virginia

Debt Collection

I loaned out what adds up to over $14000 ($5230, 5260, 3400, 500) to old room mates over a term of a year and a half. I had them sign promissory notes for the amount borrowed. The repayment date has passed by a month now, a grace period I gave, and i am wondering how likely would it be for me to get my money back in court. I know they dont have that amount of money sitting around, but they have made no attempt to repay and no payments have been received for 2 months. They have well paying serving/bartending jobs here is Fairfax working for Coastal Flats and Jacksons. I want to make sure if it goes to court is there a chance that i wont get my money due to lack of available funds on their part.

Re: Debt Collection

I assume you have let them know you are going to court if they don't start paying a set amount each week, month, etc. Hopefully you have a confession of judgment provision in the notes, that will make your job a bit easier. Getting judgment should not be hard, but collecting it is almost always the harder part. You might start with wage garnishments.
