Debt Collection

I recently filed a warrant of dept with my local court house and at the

first preceding, the defendent asked the judge what he needs to do to

counter sue for over $15,000. The defendent owes me $5,800 on a

promissory note that he stopped payment on.

Is this just a scare tactic or does he have a grounds to countersue. I can't

think of anything that I have done that would be grounds for a counter

suit. This is not a business debt, it is individual to individual.

If you're certain that the defendant has no basis for a countersuit, e.g., you don't owe him any money nor are you in possession of any of his property, then obviously it must be the scare tactic to which you've alluded.

If the guy is asking the -judge- for legal advice, this suggests that he doesn't know what he is doing.
