Legal Question in Credit and Debt Law in Virginia

I loaned money to a friend ($9000). A few months later, he and I eloped. We quickly realized our error, but too late for an anullment. We decided to keep the debt seperate from the divorce and filed for an uncontested divorce. He then signed an agreement for repayment to me which we had notorized. In the agreement there is a stipulation that if he defaults at anytime, he owes the entire amount and agree's for me to have his wages garnished. If I taked him to small claims court, would the fact that we did get married apply to the agreement that we signed. Or would it be looked at as a seperate debt not included within our divorce. We went to court and our divorce has been final for 3 weeks now. IF you can extend any help, it would be greatly appriciated. thanks!
