Legal Question in Credit and Debt Law in Virginia

Deficiancy Judgement Laws

I now live in Virginia, but originally purchased my auto in Tennessee. The car stays tore up. I can't keep up payments for having to work on it all the time. My credit is already bad and I am thinking about taking the car back to the dealership I bought it at, and leaving it. I owe way more than what it would bring, so would I be sued for the balance? I have read some states are NON deficiancy judgement states, and if so , would this pertain to my situation and which state would be considered, the state I bought the vehicle or the one I live in now?

Re: Deficiancy Judgement Laws

You should talk to an experienced consumer law attorney before you do anything. In certain circumstances, you can "revoke acceptance" and dump the car back on them. You might also run a CARFAX (carfax.com) and check the title history with the pertinent DMV's. An attorney can advise you on any claims and defenses you may or may not have. Good luck.
