Expired Rental Car Contract

I am currently renting a car from Enterprise Rent A Car. I have been renting a car from them since April 2007. In September 2007, I upgraded to the car I am currently driving; but was not given a new agreement. The existing agreement was merely extended/revised to indicate the new make/model of the car.

Recently, my credit card declined the last payment and Enterprise has been harassing me for the past week and a half for either payment or the car. They call on average 12 times per day to my cell and home phone (starting as early as 7am). Daily they threaten to report the car stolen and turn over my information to the police. Tonight, they even came to my house.

I told them that I am out of town this for work and will get them a different card number or return the car early next week.

In the meantitme, what rights do I have? Is the harassment legal? Can a rental car company come to your house to repossess a car? Is this a criminal matter or a civil matter? Please advise. Thanks in advance.

Let me see if I got this right. You have their car and haven't paid for it and are out of town and you want to know if they have the right to continually call you and come to your house to get their car, right?
