Fair credit reporting

i have never paid child support late but the state of virginia reports to my credit bureau that its late every month.i have been denied credit for this reason.how do i file a law suit against va.

Instead of attempting suit against the Commonwealth(which would go nowhere), your better approach would be to contact DCSE to determine precisely why your payments are being reported as late and then followup to make sure that whatever corrective action(s) are necessary to fix the problem--either on your part or theirs--have been properly taken.

Credit reporting issues are very tricky. The Federal law very clearly says in one place that you can sue, but in another place very clearly says you CANNOT sue. Take a moment and thank your member of Congress.

There is an interesting development (new and not yet fully developed or mature) to sue for DEFAMATION when false credit reports are reported by either the reporting entity or the credit bureau. There was a sucessful case in Richmond around 2003.

I can't see this is easy, because the law is uncertain and in flux. But is is worth giving it a try.

You would have to prove, iron clad, that you paid on time, however.
